Terms of Use

These Terms of Use (“Terms”) govern your access to and use of aldercompute.ai and its pages, tools and content (the “Site”), operated by Alder Compute Inc. (“Alder”, “we”, “us”). By using the Site you agree to these Terms. If you use the Site on behalf of an organisation, you agree to them on its behalf and confirm you have authority to do so. If you do not agree, do not use the Site.

You must be at least 18 years old, or the age of majority where you live, to use the Site.

The Site describes our business. Our compute, colocation and related services are provided only under a separate written agreement signed by Alder (such as a master services agreement and order form), which governs those services and prevails over anything on the Site. Nothing on the Site is an offer, a quote or a commitment to provide capacity, pricing, delivery dates or service levels, all of which are subject to availability and to that agreement.

Hardware specifications on the Site are drawn from manufacturers’ public documentation, may be approximate or rounded, and may change without notice. Manufacturer performance figures are the manufacturer’s own claims or projections.

The 3D models, cluster explorer, power, cooling and network diagrams, maps and other visualisations are illustrative and representative. They are not engineering drawings, bills of materials, site plans or commitments about any particular deployment. Site locations are shown approximately.

Statements about planned sites, capacity, technology and timelines are forward-looking. They reflect our current plans and expectations and involve risks and uncertainties — including power, equipment supply, construction and regulatory factors — that could cause actual results to differ materially. We do not undertake to update them.

The Site and its content — including text, graphics, 3D models, visualisations, software, design and the selection and arrangement of these — are owned by Alder or its licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to view and use the Site for your internal business evaluation or personal, non-commercial purposes. All other rights are reserved.

“Alder Compute”, “Alder” and the Alder logo are trademarks of Alder Compute Inc. NVIDIA, Blackwell, GB300, HGX, NVLink, ConnectX, BlueField, Quantum-X800 and Spectrum-X are trademarks of NVIDIA Corporation, and other names may be trademarks of their respective owners. Their use on the Site identifies the products we build with and does not imply endorsement, sponsorship or partnership unless we expressly say so. You may not use our trademarks without our prior written permission.

You agree not to:

• use the Site in violation of any law or regulation, or to infringe anyone’s rights;
• copy, scrape, harvest or extract content or data from the Site by automated means, other than standard search-engine indexing that respects our robots.txt;
• probe, scan or test the vulnerability of the Site or circumvent any security or rate-limiting measure (report vulnerabilities to us instead, as described below);
• interfere with or disrupt the Site, or impose an unreasonable load on its infrastructure;
• submit false, misleading or automated requests, or impersonate any person or organisation;
• reverse engineer the Site’s software, except to the extent the law expressly permits;
• use the Site or its content to build a competing product, or to train machine-learning models, without our written consent.

Security research. If you believe you have found a security vulnerability in the Site, email info@aldercompute.ai with the details. Please give us reasonable time to fix it before any disclosure, and do not access or modify data that is not yours.

Information you submit through the Site must be accurate and yours to share. Please do not submit confidential or proprietary information through the Site; no confidentiality obligation or other relationship arises from a submission unless we agree to one in writing. Our Privacy Policy explains how we handle personal information.

If you send us ideas, suggestions or other feedback, you grant us a perpetual, irrevocable, royalty-free licence to use it for any purpose without obligation to you.

The hardware, technology and services described on the Site are subject to U.S. export control and economic sanctions laws, including the Export Administration Regulations and regulations administered by the Office of Foreign Assets Control. You represent that you are not located in, organised under the laws of, or ordinarily resident in a country or region subject to comprehensive U.S. sanctions, and are not on, or owned or controlled by a party on, any U.S. government restricted-party list. We do not provide services where doing so would violate these laws.

The Site may link to or rely on third-party websites and services. We do not control them and are not responsible for their content, policies or practices; your use of them is at your own risk and subject to their terms.

The Site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We do not warrant that the Site will be uninterrupted, secure or error-free, or that its content is complete, current or free of harmful components.

To the fullest extent permitted by law, Alder and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the Site or these Terms, even if advised of the possibility of such damages. Our total liability for all claims arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow these limitations, so they may not all apply to you.

You will defend, indemnify and hold harmless Alder and its affiliates, officers, employees and agents from any claims, losses, liabilities, damages and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your breach of these Terms.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Delaware, and you and Alder consent to their personal jurisdiction. Either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

We may change the Site, or suspend or end access to it, at any time. We may update these Terms by posting a new version with a new effective date; continued use of the Site after that date means you accept the updated Terms. We may suspend or terminate your access if you breach these Terms.

These Terms and our Privacy Policy are the entire agreement between you and Alder about the Site and supersede any prior understanding about it; they do not affect any separate written agreement for our services. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
